The Supreme Court on Friday will hear the plea filed by a group of 29 minority shareholders seeking the recall of its order referring the Jindal Poly Films class-action dispute to arbitration. On Wednesday, senior advocate Kapil Sibal mentioned the class-action matter against Jindal Poly Films before the Chief Justice of India on behalf of the minority public shareholders of Jindal Poly Films.
Sibal sought the Court’s intervention into how a pending class action (an in rem proceeding, admitted before the NCLT) came to an abrupt halt by way of a settlement by one sole shareholder with the company. It was submitted that the dispute was referred to arbitration during the summer vacation without other shareholders being informed. The Chief Justice allowed the mentioning and listed the shareholders’ miscellaneous application for July 17.
